CONSENT TO USE IMAGE
I hereby consent and authorize Centre for Immigrant and Community Services to take my photograph/image and/or the photograph/image of the child below, for whom I am the parent and/or legal guardian (collectively, “Image”). I acknowledge and agree that Centre for Immigrant and Community Services and their funders may publish, display or use the Image for any purpose and by any means whatsoever including, but not limited to, electronic or digital means. I acknowledge that Centre for Immigrant and Community Services may not be able to control the distribution or use of the Image by other than Centre for Immigrant and Community Services representatives. I agree that this consent is given in perpetuity and for no consideration, credit, acknowledgement or financial recompense, now and in the future. I hereby waive, release, and forever discharge the Releases from and against any and all Liability whatsoever which may result from the taking, use, display, publication or distribution of the Image.
WAIVER, RELEASE, INDEMNITY, AND ASSUMPTION OF RISK AGREEMENT
I understand and agree that my participation either as a program participant and/or a volunteer in any events, programs, group rides, workshops, clinics, or any activities organized, promoted, operated, conducted, and/or sanctioned by the “City of Markham,” and "Centre for Immigrant and Community Services" or any of our partner organizations and funders is conditional upon my execution of this document.
Markham Cycles is a multi-stakeholder program led by Centre for Immigrant and Community Services and supported by The Centre for Active Transportation (a project of Clean Air Partnership), City of Markham, York Region District School Board, Markham Public Library, and City of Markham Cycling & Pedestrian Advisory Committee.
I am aware that riding a bicycle involves the possibility of severe, long-term injury or death. I am aware that repairing, working on, tuning, and/or maintaining bicycles with hand or power tools and participating in the Bike Repair, Do-It-Yourself Drop-In program involves the possibility of severe, long-term injury or death. I am aware that my risk of injury increases as I become fatigued. I am aware that my risk of injury may be reduced if I follow all the rules established for participation. I am aware that I may experience anxiety while challenging myself while riding a bicycle or participating in any activities related to Markham Cycles.
I accept these risks, and all others arising from these events and programs, even if arising from the negligence, gross negligence or negligent rescue by those associated in any way with the Centre for Immigrant and Community Services events and programs I may be involved in; by the venues at which these events and programs take place; or by those organizing, officiating, or participating in these events and programs throughout the year, including their respective officers, directors, employees, agents, servants, volunteers, and representatives (Centre for Immigrant and Community Services).
I understand that all applicable rules for participation must be followed, including those outlined in the Markham Cycles safety protocols and that SOLE RESPONSIBILITY FOR MY PERSONAL SAFETY, AND THE SAFETY OF MY CHILDREN, REMAINS WITH ME, including my physical and emotional preparation and fitness to participate in all events and programs.
>I undertake and agree to remove myself from participation if I sense or observe any unusual hazard or unsafe condition, or if, at any time, at any event or program, I feel unable or unfit to safety continue for any reason.
I further undertake and agree to be responsible for the safety of my children, should they accompany me to any programs or event, and to remove said children from participation if I sense or observe any unusual hazard or unsafe condition.
I agree that a medical doctor has verified my physical condition and that he/she has confirmed that I am able to ride a bicycle and participate in Markham Cycles events, activities, and programs. I agree that the rules of participation must be followed and that I am the sole responsibility for my safety, including physical fitness and emotional preparation. I agree to discontinue participation if I observe any unsafe conditions/hazards, or if I feel unable or unfit to continue.
I give a FULL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I have, or may have in the future, against Centre for Immigrant and Community Services and from all liability for any loss, loss of future income, damage, injury, or expense that I may suffer, or my children may suffer, as a result of my participation in any part or parts of the events or programs or my presence at any venue at which they may take place, due to any cause whatsoever including the forms of negligence set forth in Section 2 above or from any breach of contract or statutory duty or other duty of care including any duty of care owed under the relevant Occupier’s Liability Act, on the part of the Centre for Immigrant and Community Services.
I AGREE TO FOREVER RELEASE THE CENTRE FOR IMMIGRANT AND COMMUNITY SERVICES, NOT TO SUE, and I further agree TO INDEMNIFY AND SAVE HARMLESS Centre for Immigrant and Community Services from all expenses, costs (including legal fees), actions, losses, judgements, liability or damage award or cost of any type whatsoever arising from my participation, or my children’s participation, in any of these events or programs.
